what is a kink meme? it pretty much gives itself away; you request a pairing and a prompt/kink anonymously, and someone else (or several someone elses for that matter) will be able to fill that request- also anonymously. it's a great way to get fic, a nice way to find fic to write and if you're embarrassed to post porn, like me!

(note that while this is called a kink meme, the rules are pretty lax. nonexplicit fic is also allowed, though pure gen is generally discouraged.

however. i'll be pretty lax about that as well, so long as an emphasis is placed on either a) kinky stuff or b) some form of character relationship, even non sexual/romantic. please, bear in mind this is a kink meme first and foremost, okay? ;)

Chris had never felt so uncomfortable in his life.

He was sitting at the glass table, avoiding eye contact but still aware that everyone was looking at him. He didn’t really know why he had even been called in to give a deposition; Dustin, sure, but Chris couldn’t offer them anything substantial that would help either Mark or Eduardo in this lawsuit.

He was just Chris; a suit that he hadn’t worn since graduation tight along his shoulders, the expectation of both Mark and Eduardo bearing down on him and unable to make either lawyer see that all he wanted was Eduardo and Mark back to normal again.

“Mr. Hughes - may I call you Chris?”

Chris finally raised his head. Eduardo’s lawyer - Gretchen ‘may i call you’ Whatever - was smiling at him in that fake way that she looked at everyone, including Eduardo. Her nail polish was bright and ridiculous against the table. It was immaculate and fresh; obviously not someone who used her hands a whole lot. He wondered if she had callouses on her fingers from continuous typing at a keyboard or the curse of code running through her thoughts every second. He wondered if she cared about numbers and algorithms and how they fit into life, or if she had a best friend who needed her to make sure that they ate and drank and spent time in the real world.

He wondered if she even cared who Eduardo and Mark really were or if it was just the big fat cheque she would be receiving in the end.

He shrugged, not really bothered what she called him as long as she got this over with quickly. Chris didn’t like being stuck in the middle but this was important, or so Dustin had been telling him over and over, although Chris didn’t see why anything he had to say would swing in either sides favour. He just wanted to be left alone. He was already losing one friend; he didn’t want to lose another.

Eduardo and Mark - to Chris’ continued gratitude - had yet to look at him, staring at the opposite wall or doodling on the pad in front of them. They were doing their best to keep from pressuring him but that didn’t make it any easier to sit there and relive Harvard and everything after like all it led up to was this lawsuit and the breakdown of a friendship.

“Chris, were you aware of a conversation that took place between Mr. Saverin and Mr. Zuckerberg during a -”

Chris let her talk herself into a question. He didn’t even want to be here. Couldn’t she see that?

“- because Mr. Saverin had been ‘punched’ by the Phoenix club?”

Chris frowned. “Mark called Eduardo outside but I wasn’t present for the conversation after they left the building.”

He hadn’t been present for any of the conversations and he wasn’t really sorry. It was bad enough recounting FaceMash and their night of coding and derogatory attitude towards the girls in the dorms. He was aware of Eduardo pumping money into the company and Mark taking advantage, Mark always taking advantage, but he had always just assumed that it would work itself out; that Eduardo would wise up or that they were both aware and had come to some sort of - well, agreement would be the right word except not. It had always just been Eduardo and Mark and what they did. Chris couldn’t even explain it properly.

“Were you aware that Mr. Saverin had been putting money into the company?”

“Of course,” Chris said, resisting the urge to clench his fists. He rested them on the table, palm down. “Mark asked, Eduardo handed over the money.”

“Would you say that Mr. Zuckerberg was taking advantage of Eduardo?”

Mark shifted in his seat and Chris could see the lawyer - Sy? - about to speak but he leaned forward, staring down at his hands. “That’s just how Mark and Eduardo always are - or were.”

“One took and the other gave?”

“No,” Chris said, looking up at Gretchen angrily. “You don’t know what it was like. They were - they worked that way, okay? I guess it can’t have been easy on Eduardo and it wasn’t like he deserved it or anything. We expected - but it was just, Mark and Eduardo were just that way.”

“You said ‘we expected’. You expected what?”

Chris tapped his fingers against the table. “We expected fallout of some kind. Mark wasn’t the kind of person who noticed things easily. You couldn’t hint or beat around the bush; if you didn’t make your point clear or well enough, Mark would tune out and stop listening. Eduardo knew that better than any of us and if he’d wanted Mark to know, than he would have said something.”

“Wanted Mark to know what?”

Ignoring Gretchen, Chris stared at Eduardo who was looking at him, eyes wide and dark. He was tense and angry but Chris didn’t know if that was because of what he was saying or because he was just angry at everything. Mark’s pen had stopped scratching against the paper.

Eduardo leaned across to Gretchen, whispering in her ear and at her frown, Chris knew he had just asked her to stop this. Chris didn’t know if he wanted to, not know. Let them all know what this lawsuit was really about.

“Why he always gave and let Mark take. Why we were all waiting for fallout. Why it was always going to end in disaster, even if we had all willed ourselves into believing it wouldn’t.”

“Stop,” Mark said, fists clenched on the table in front of him. He wasn’t staring at Chris, though, but at Eduardo. “This doesn’t matter. It doesn’t - it has nothing to do with Facebook or what happened at the end.”

Eduardo flinched but he was still tense and staring at Chris, betrayed.

Sy interrupted again. “I don’t see what any of this has to do with the lawsuit, Gretchen. If the Mr. Hughes knew all along that something was going to happen and didn’t step in to stop Mr. Saverin abandoning my client, then-”

“He didn’t abandon me,” Mark said, voice so quiet in the room that Chris almost didn’t hear him.

Chris knew that his deposition wasn’t turning out quite the way anybody had hoped but that’s what they should have expected. This wasn’t just a lawsuit about Facebook and who deserved to have a claim to it; this was a lawsuit about a friendship that had snapped under the weight of expectation and neglect. About a friendship that could have been something more if either party had been strong enough to actually say something instead of taking the long way around.

“You always had to make everything so difficult,” Chris said, not caring if they both thought he was talking to them. In truth, he didn’t even know. “It could have been alright if you’d just talked to each other.”

There was silence again and Chris was angry, now. Angry that he’d been dragged into this, angry that Dustin was going to be angry about this, angry about everything.

“I don’t know what you’re expecting me to say,” he snapped. “I don’t know what I can say that you shouldn’t already have figured out for yourselves. They were friends. This was never going to be clean cut and normal. Look, I just want to - can I please go the bathroom?”

He could feel Mark and Eduardo looking at him and it was uncomfortable and hot and suffocating. He just wanted to get out.

“Sure,” Gretchen said with an almost genuine smile this time. “Take five.”

“Excuse me,” Chris said, retreating to the safety of the bathroom.

He pressed his hands to the sink and bent his head forward, closing his eyes. This was turning into one of the worst days he had ever experienced and he was hating every moment of it. It was hard to sit across from Eduardo and watch him, eyes dark and haunted, as Chris recounted everything that had happened. Chris wasn’t around for anything in California, not really, but he knew enough from Dustin to know what that must have cost Eduardo and what it was still costing Mark.

Dustin would be better at him than this; he’d know what to say.

“I don’t know what you want me to say.”

Dustin didn’t think they’d appreciate hearing that he’d spent most of Harvard drunk or passed out in his room, Mark’s room or on the common room floor. He didn’t think they’d appreciate hearing about his drunken fumbles with girls and guys, or the way he’d always thought in code.

He did think they could do with hearing about all the times he’d walked in on Eduardo and Mark making out or jerking off. Maybe they’d realise this whole thing was just shit. Eduardo was angry and jealous and betrayed, Mark was angry and sad and betrayed.

“Things were going fine,” he said, clenching his fists, “until Sean Parker.”

Dustin had never really liked Sean Parker. It had been easy to fake, especially for Mark, who’d looked on Sean like his Knight in shining armour. He had been difficult to get along with and his penchant for small girls and drugs had never sit well with Dustin. He’d liked even less that Mark seemed to neglect Eduardo in favour of his new friend, all because Facebook was benefiting from his expertise. Dustin had never been able to express his own doubts because Mark had been so blinded to criticism of Parker.

Dustin had always suspected that Eduardo had been more jealous over facebook than he had been over Sean but he’d always had sense enough not to say that out loud.

“Mark seemed to - I don’t know, it was like he was something fresh and new.” Dustin avoided looking in Mark’s direction. “Eduardo had been like that once; something new and exciting and he looked at Mark like he was the best fucking thing in the world, excuse my language. The Facebook was taking off and along comes Sean, fresh and new and looking at Mark like he’s the best thing in the world.”

“And Eduardo?”

“He’d stopped looking at Mark like that. He was Mark’s best friend; why should he want to look at Mark like that anymore? I guess he just expected Mark to always know.” Dustin swallowed and resisted the urge to run a hand over his eyes. “Sean didn’t seem to care about their friendship, not really. He just wanted in on the company and I’m sure he wanted to genuinely help but that’s when everything changed.”

Sy was staring at Dustin intently and Dustin half expected him to discount everything he had said, to tear it to pieces; not that he really cared. No lawyer in this room had worked with Mark or Sean. They didn’t know about the delicate balance that had always existed between them that had everything to do with when they could mention Eduardo and when they couldn’t.

“This lawsuit is not being waged against Sean Parker.”

“No,” Dustin said. It shouldn’t even be a lawsuit at all.

Everyone was looking at him expectantly but he didn’t know what they wanted him to say. He could lie and say that Eduardo was already being pushed out of the company then but he honestly didn’t know if the thought had even crossed Mark’s mind. He could say that Mark was only trying to protect Eduardo, that he hadn’t even known what was in the new contracts but that would have been a lie, too.

“Mr. Muskowitz, were you or were you not aware that Eduardo Saverin’s shares in Facebook were diluted down?”

“I knew there were new contracts. I just didn’t know what they were going to do with Eduardo.

There was silence.

“I didn’t know.”

Sy shifted some papers in a manilla folder. “Would you-”

Dustin listened and he spoke. He talked for what seemed like hours about Eduardo and Mark and it was like he was outside, looking in. It didn’t feel like him and it didn’t feel like Eduardo and Mark. They were different people and these things had never really happened.

He’d always joked with Chris about being the depositions being like a divorce and how they’d be forced to choose but now it was actually happening and he was having to look both of them in the eye and lie for them; not reveal that he’d seen them kiss and talk and act like people. He wanted to shake them and make them remember that they had once been the best thing about the other.

He didn’t know if it was too late for that, now.

Oh, this is heartbreaking. I love how you've depicted Eduardo and Mark as both Chris and Dustin's, like, role model couple or something. Not very literally but you can tell they were very fond of them together. Gosh, so sad. ;_;

This was really great, both Chris and Dustin's takes. Did you finish the second part of Dustin's depositions? I would love to read it.
